What is the VICTORIAN POOL Inspection and Compliance process ?

  1. The owner must register their pool or spa with the local council.
  2. The local council must provide the owner with a letter specifying the date of construction and applicable standard.
  3. We  inspect your pool or spa to the applicable standard and provide a report.  If appropriate we issue a certificate of compliance.

  • We can provide an optional Pre-compliance check.
  • You must lodge  your certificate of compliance with your council with in 30 days
  • If you pool does not pass the first inspection,  a 60 day rectification notice is issued to the owner.
  • We provide a Second compliance inspection.  It must be within 60 days of the First compliance inspection.

What is the Certificate of non-compliance ?

The certificate of non-compliance is a form that can be issued by the inspector if they deem that the pool or spa barrier poses an immediate danger to life or they do not believe the owner can rectify issues within the specified time period.  The form ( also known as form 24) is specified by legislation and must be provided to the local council and is copied to the owner.  Form 24 lists the reasons for, and details of the non-compliances.

Will my pool or spa fail the first inspection ?

Most older pools and spas will fail the first inspection.

What if I do not get my pool or spa barrier inspected or rectified ?

For each non-compliance, depending on the severity, fines greater than $1500 can be issued.

Also, the legislation allows the council to enter your land to determine and enforce compliance.

WHO IS RESPONSIBLE FOR GETTING CERTIFICATION ?

The property owner is responsible for obtaining and lodging pool and spa compliance certification.

WHO IS RESPONSIBLE FOR MAINTAINING THE POOL OR SPA BARRIER ?

The property owner is responsible and must take all reasonable steps s to ensure the barrier is properly maintained.

WHO IS RESPONSIBLE FOR barrier operation and POOL OR SPA access ?

The occupier of the land is responsible and must take all reasonable steps s to ensure the barrier and entry gates and doors restrict access except when in proper use.

WHEN MUST THE BARRIER BE INSPECTED ?

All domestic pools and spas must be inspected for compliance every four years.   Please refer to the "Key dates" tab on our home page  for the first "must be inspected by" dates.
