The certificate of non-compliance is a form that can be issued by the inspector if they deem that the pool or spa barrier poses an immediate danger to life or they do not believe the owner can rectify issues within the specified time period. The form ( also known as form 24) is specified by legislation and must be provided to the local council and is copied to the owner. Form 24 lists the reasons for, and details of the non-compliances.
Most older pools and spas will fail the first inspection.
For each non-compliance, depending on the severity, fines greater than $1500 can be issued.
Also, the legislation allows the council to enter your land to determine and enforce compliance.
The property owner is responsible for obtaining and lodging pool and spa compliance certification.
The property owner is responsible and must take all reasonable steps s to ensure the barrier is properly maintained.
The occupier of the land is responsible and must take all reasonable steps s to ensure the barrier and entry gates and doors restrict access except when in proper use.
All domestic pools and spas must be inspected for compliance every four years. Please refer to the "Key dates" tab on our home page for the first "must be inspected by" dates.

In most cases a building permit is required when:
1. Replacing / installing a boundary fence that forms part of a pool / spa barrier.
2. Replacing / altering sections, parts or components of a barrier that when combined, comprise more than 50% of the existing barrier length.
3. Replacing / altering posts or footings of a barrier.
4. The use of materials in the barrier that are not commonly used for the same purpose as the material being replaced in the barrier.
5. An increase or decrease in the length of the barrier, or the size of the area enclosed by the barrier.
6 Replacing / altering any part of a retaining wall that forms part of the barrier.
7. Installing a new pool / spa barrier.
1. If you require a building permit, most councils will upgrade you to the latest standard.
